By making a booking with Racing Events you agree to the following terms and conditions:

Booking

1. Racing Events does not make any offer capable of acceptance and is entitled to refuse any booking placed by you.

2. If your booking is accepted, Racing Events will send you an invoice, or e-mail or telephone you confirming acceptance of your booking.

3. Your confirmatory notification will inform you with whom your contract is made – in some cases it will be Racing Events in other cases it will be a third party.

4. Where your contract is not with Racing Events but with a third party :

(a) Racing Events may pass on your credit card and any other essential booking details to that third party. The making of a booking by you will constitute consent to Racing Events passing on such details.

(b) you will be subject to that party’s terms and conditions and you should read these before proceeding with your booking with that third party.

5. You undertake that all details you provide to Racing Events for the purpose of booking are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the booking.

6. If there are any changes to the details supplied by you it is your responsibility to inform Racing Events as soon as possible.

7. Racing Events will not send you e-mail that you don’t want but cannot guarantee that third parties to whom your details are sent won’t do so.

8. Costs of foreign events may be subject to currency fluctuations.

Payment

9. A non-refundable deposit of 50% of the overall price of the booking is payable within 7 days of acceptance of the booking. The balance must be paid at least 60 days prior to the event. Any booking made within 60 days of an event is payable in full, immediately upon acceptance of the booking. Should any amounts not be paid by the due date, Racing Events at their sole discretion, will be entitled to treat the booking as cancelled by you and to charge cancellation fees as set out below.

10. Racing Events reserves the right to charge interest compounded monthly on all overdue accounts at the rate of :

(a) 3% over the base rate of Royal Bank of Scotland from time to time in force; or

(b) the rate of statutory interest for the purposes of the Late Payment of Commercial Debts (interest) Act 1998

whichever is the higher.

Prices

11. All prices quoted are exclusive of VAT, which will be charged in addition to the booking price. Racing Events reserves the right to alter published or confirmed prices at any time prior to the event to cover increased costs incurred.

Availability

12. All packages offered are subject to availability.

Alterations to the Package

(a) By You

13. Any request from you for a variation to a booking must be made in writing and is only effective if accepted in writing by Racing Events. An amendment fee of up to £50 per person may be charged in addition to any increase, if necessary, in the costs of the alternative arrangements.

(b) By a Third Party

14. When arrangements and/or facilities for an event are changed or cancelled by a third party, Racing Events will use all reasonable endeavours to provide a suitable alternative and/or secure a refund for you only of monies paid to a third party. Racing Events however is not obliged and cannot guarantee to provide such alternative or secure such refund.

(c) By Racing Events

15. Racing Events will use all reasonable endeavours to adhere to the confirmed arrangements but Racing Events reserves the right at its sole discretion to alter, omit or change arrangements should Racing Events consider it necessary to do so and shall have no liability whatsoever to you for such changes save a refund of any monies not expended.

Cancellation

(a) By You

16. All cancellations must be made in writing. Should you wish to cancel the booking for whatever reason, the following charges will apply:

(i) If you cancel a booking or part of a booking more than 60 days before an event, you shall be liable for 50% of the total price of the booking.

(ii) If you cancel a booking less than 60 days before an event, you shall be liable for the total price of the booking.

In either case, Racing Events will use all reasonable endeavours to resell the package on your behalf, and if successful, will refund you the full price of the booking less the deposit paid.

(b) Cancellation of the Event

17. Sometimes for reasons outside our control, an event is cancelled or abandoned by its organisers. In these circumstances Racing Events may be able to secure a full or partial refund from the organisers. If Racing Events are successful in obtaining a full or partial refund, Racing Events will reimburse or give credit to you, of the value of any refund received by Racing Events less the deposit paid by you.

Liability

18. Racing Events attempts to ensure that the information available on the web site at any one time is accurate. However, Racing Events cannot guarantee that it will be fault-free and cannot be responsible for goods and/or services offered by Racing Events as agents for third parties or for any aspect of the relationship between you and that third party.

19. Racing Events does not accept liability for any errors and omissions and reserves the right to change information, specifications and descriptions of listed goods and/or services.

20. Racing Events will do its best to correct errors and omissions as quickly as practicable after being notified of them.

21. This web site contains hyperlinks to web sites operated by parties other than Racing Events. These hyperlinks are provided for your reference only. Racing Events does not control such web sites and is not responsible for their content.

22. Racing Events makes no representations about the fitness for a particular purpose of any of the products or services available through Racing Events.

23. Racing Events does not accept liability for any indirect or consequential loss arising out of the use of the web site or for any products or services purchased through Racing Events.

24. Racing Events will only be liable for direct loss (save in the case of death or personal injury in respect of which there is no limit) up to a maximum total of the booking price in respect of any claim.

25. Where your contract is not with Racing Events but with a third party, Racing Events acts only as your agent and no liability of any kind shall attach to Racing Events in connection with or arising from the arrangements between you and the third party. You agree to indemnify Racing Events against any claim made by such third party.

26. This Liability section applies only to the extent permitted by law.

General

27. Every booking you make shall be deemed performed in England. English law shall govern every aspect of contractual agreement concerning bookings made with Racing Events.

28. Racing Events may amend these terms and conditions from time to time, and post the new version on the web site. When this happens, Racing Events will mention the fact on its home page, www.racingevents.co.uk. All bookings made from the date of posting onwards will be governed by that new version.

29. These terms contain the entire agreement between you and Racing Events relating to your booking. If any of these terms are held to be invalid or unenforceable, such terms will be deemed struck and the valid terms will remain.
